India Strengthens Immigration Laws: Key Fines, Penalties, and Updates

With the Immigration and Foreigners Bill of 2025, India plans to update its immigration laws. This new law intends to improve economic growth and tourism while strengthening national security, streamlining visa requirements, and combining many current laws. What you should know is as follows:

  • Strict Penalties For Forged Documents: Using or providing forged travel documents will now result in harsh penalties, including fines of INR 1 lakh to INR 10 lakh and jail time of two to seven years.
  • Crackdown On Overstaying: Foreign nationals who break the terms of their visa or overstay it may be fined up to INR 3 lakh and imprisoned for up to three years.
  • Mandatory Reporting By Institutions: Institutions are required to notify immigration officials of their presence, including hotels, hospitals, schools, and other facilities that host foreign nationals. This will assist in keeping an eye on those who overstay their visas.
  • Accountability Of Transport Carriers: Airlines, shipping firms, and other transport providers are required to confirm that passengers possess legitimate travel papers. They risk penalties or possibly having their cars taken if they don’t comply.
  • National Security Comes First: People who are seen to pose a danger to India’s sovereignty, public order, or national security may now have their visas revoked or denied admission.

Merging Old Laws For Simplicity

To make the immigration procedure more efficient, the bill combines and repeals four outdated laws:

  • The Passport (Entry into India) Act, 1920
  • The Registration of Foreigners Act, 1939
  • The Foreigners Act, 1946
  • The Immigration (Carriers’ Liability) Act, 2000

The government hopes to improve the ease of doing business, lower bureaucratic barriers, and simplify rules by combining these laws.
